Although, legislation was introduced in Congress as early as 1913 to protect the towering mountains of south-central Idaho as a national park, the issue did not generate significant interest until the 1960s. When American Smelting and Refining Company began exploring molybdenum deposits at the base of Castle Peak in the White Clouds in 1968, conservationists rallied around the call to ‘Save the White Clouds.’ Idaho Senator Frank Church proposed legislation to protect the mountains with either a Forest Service administered national recreation area or a national park. The issue found the national spotlight in January 1970 as Life magazine published an article on the land-use controversy. In November of the same year Cecil Andrus took over the governor’s office from incumbent Don Samuelson largely because Andrus opposed mining in the White Clouds. Despite all of Idaho’s congressional delegation supporting a national park and recreation complex, the legislation was modified in 1971 to create only a national recreation area under Forest Service management. Congress passed the bill and President Nixon signed the measure in 1972. The years between 1968 and 1972 offer an interesting glimpse into the conservation struggle in Idaho and how the emerging environmental movement reached even the highest peaks of central Idaho. The controversy highlights public concern over federal land use, reveals tensions between the Forest Service and National Park Service, and explores the dynamic relationship between politics and land management decisions. This in-depth analysis of the historic landscape describes the effect of external environmental stimuli and local culture on land use in this region of Oregon. This study develops a classification system to describe how perceptions of Mount Hood have changed over time, and also investigates associated land use within each of these categories. Eight perception categories are employed: Reverence, Respect, Obstacle, Exploration, Livelihood, Economic Development, Conservation and Preservation, and Research. This historic landscape reconstruction employs comprehensive acceptance, integration, and comparison of various source materials to minimize bias. Though some courts have suggested that the public trust places limitations or the power of the legislature to convey lands beneath navigable waters, this view conflicts with the basic theory of state government that recognizes plenary power in the state legislature to the extent that it is not constitutionally limited. The trust theory does, however, place definite restrictions on the state agency authorized to sell and maintain submerged and submersible lands. These restrictions arise from the basic presumption that the legislature will not intend a conveyance of lands in derogation of traditional public rights in the use and enjoyment of the waters, a presumption which stems from the inherent importance of the free navigability of the waters. Any land conveyed by the state, therefore, is and has been subject to the public right of navigation. However, though the grantee of the state takes subject to the public right of navigation, not every interference with that right will be enjoinable, since the test is one of public nuisance that involves a balancing of the conflicting interests. Principal products: Alfalfa, hay, grain and vegetables; stock,poultry, and dairy products. Principa; markets: Portland Oregon; Sacramento and San Francisco, Ca. Limit of area of farm units: 160 acres. The irrigation plan of the Klamath Project provides for the storage of water in Upper Klamath Lake, lying just North of Klamath Falls, Oregon, and in Clear Lake Reservoir, California, at the head of Lost River. Water for lands in Langell Valley and in the vicinity of Bonanza will be supplied from Clear Lake Reservoir and from Gerber Reservoir. Water for all other lands will be supplied from Klamath Lake. Water is diverted from the outlet of Upper Klamath Lake just above the Link River Dam, into the "A" Canal which extends nine miles in a southeasterly direction, and supplies the canals on both sides of Lost River. Water for the Tule Lake lands, which are served by the "J" Canal, is discharged into Lost River from the C-G Canal and from this point to the diversion dam two miles southeast of Merrill; Lost River being used as a carrier. At the diversion dam, the water is diverted into the "J" Canal. One of the principal features of the Klamath Project is the reclamation of the lands in the bed of Tule Lake. These lands are being reclaimed in a double sense: first, by causing the waater recede and, second, by constructing irrigation works to irrigate the lands uncovered. The lowering of the water surface in Tule Lake is being brought about by evaporation from the lake itself and by preventing inflow. The works designed to prevent inflow consists of Clear Lake Reservaoir, and the Lost River diversion canal. Clear Lake Reservoir is located at the head of Lost River and stops the flood waters coming in from abouve. Flood waters coming in Lost River below Clear Lake are diverted from Lost River int the Klamath River through the diversion canal. The works designed to provede irrigation service for the uncovered lands consist of a diversion dam on Lost River tow miles southeast of Merrill, the "J" Canal and lateral system. The Keno Canal has been constructed on the West side of Link River and extends from the Link River Dam to a point about one mile below; the river in this distance makes a drop of about 50 feet. The Keno Canal was designed to develop power and to supply water for irrigation to lands on the west of Klamath River, also, to the marsh lands around Lower Klamath Lake. The irrigation plan of the Klamath Project provides for the storage of water in Upper Klamath Lake, lying just North of Klamath Falls, Oregon, and in Clear Lake Reservoir, California, at the head of Lost River. Water for lands in Langell Valley and in the vicinity of Bonanza will be supplied from Clear Lake Reservoir and from Gerber Reservoir. Water for all other lands will be supplied from Klamath Lake. Water is diverted from the outlet of Upper Klamath Lake just above the Link River Dam, into the "A" Canal which extends nine miles in a southeasterly direction, and supplies the canals on both sides of Lost River. Water for the Tule Lake lands, which are served by the "J" Canal, is discharged into Lost River from the C-G Canal and from this point to the diversion dam two miles southeast of Merrill; Lost River being used as a carrier. At the diversion dam, the water is diverted into the "J" Canal. One of the principal features of the Klamath Project is the reclamation of the lands in the bed of Tule Lake. These lands are being reclaimed in a double sense: first, by causing the waater recede and, second, by constructing irrigation works to irrigate the lands uncovered. The lowering of the water surface in Tule Lake is being brought about by evaporation from the lake itself and by preventing inflow. The works designed to prevent inflow consists of Clear Lake Reservaoir, and the Lost River diversion canal. Clear Lake Reservoir is located at the head of Lost River and stops the flood waters coming in from abouve. Flood waters coming in Lost River below Clear Lake are diverted from Lost River int the Klamath River through the diversion canal. The works designed to provede irrigation service for the uncovered lands consist of a diversion dam on Lost River tow miles southeast of Merrill, the "J" Canal and lateral system. It is a starting point from which to build a network that connects, educates, and motivates stakeholders within the Johnson Creek Watershed to facilitate effective participation in the land use process. The Johnson Creek Watershed Council contracted the Watershed Network Group (WNG) to design the Network as a mechanism for organizing efforts to promote environmentally sound development throughout the watershed. The Johnson Creek Watershed Council comprises representatives from government, residents, and business organizations with interest in the Johnson Creek Watershed. The need for a Land Use Network within the watershed arose because existing methods of monitoring and managing the effects of development on the watershed are inadequate for meeting current development pressures. Development pressures on the watershed have had negative effects on the watershed environment. Development pressures are expected to increase as expansion of the Urban Growth Boundary makes more land available for development. Currently, each jurisdiction addresses the impacts of development as they occur within its own boundary. However, the Johnson Creek Watershed extends across several jurisdictional boundaries, and environmental impacts are not confined to the jurisdiction of origin. The Johnson Creek Watershed Council was formed in 1992 to monitor and manage impacts across boundaries, on a watershed-wide basis. To operate effectively, the Council needs a way to establish two-way communication among all stakeholders in the watershed. A Land Use Network would help fill that need by providing a focal point for gathering and distributing land-use information. It would organize the information-gathering process, develop educational materials for public distribution, and organize the distribution channels. To develop the Land Use Network plan, the WNG researched the history of the watershed and its regulatory environment, theories of communication, and information on citizen participation networks. The WNG also conducted interviews and focus groups with current stakeholders to help clarify issues and identify communication needs that a Land Use Network might address. Finally, the WNG outlines a proposal for the Land Use Network. The proposal begins with a Network Structure diagram that illustrates the main elements of the Network Proposal. The elements of the Network Structure show how the Network can function effectively in the land use planning process. The issues, recommendations and actions provide methods for implementation for each element of the Network Structure. Year: 1999 Based on the research completed to date regarding the various components of the Oregon farmland preservation program, one question begs to be asked: "Is there still a need for the Special Assessment Program within Oregon's current land use planning system?" This paper is an attempt to assess the role of the Special Assessment Program in the context of the overall land use planning system in Oregon. It is my contention that the Special Assessment Program no longer plays a meaningful role in the movement to preserve land in the rural areas of the state. Also, it may actually have perverse effects on the market for land in Oregon's urban areas. I believe that the state's much-heralded farmland protection program can continue to be effective at preserving land without the tax incentive component. Finally, I believe that the citizens of Oregon would be made better off by ending the program. The paper will begin with a brief discussion of farmland loss and the various programs used to prevent that loss. Next, there will be a review of the history and legislative intent behind both the Special Assessment Program and the statewide land use planning system. This will be followed by a demonstration of how both the Assessment Program and the planning system interact.
