In the case of fisheries interactions with marine mammals and sea turtles, the preferred policy instrument has been a command-and-control approach such as effort reductions (e.g. area closures) and/or technology standards (e.g. gear modifications), even though market based approaches are available. Since monitoring, compliance and enforcement is more challenging and costly for protected resources this can be significant in the choice of instrument. We examine a case study to identify current and alternative criteria that can be used to identify the strengths and weakness of various policy instruments designed to protect marine mammals and sea turtles. The purpose is to identify management and enforcement costs, management being defined as regulations necessary to overcome the open access problem. Management costs thus include costs of devising and enforcing fisheries regulations. They also include stock assessments and monitoring at sea, but do not include research with a more academic orientation, search and rescue operations, and various infrastructure such as fishing harbors. The figures cover the period 1990-1999. The management costs amount to 7-13 percent of the catch value, a variation which is primarily due to the variability of the annual catch value. Total expenditures on the fisheries sector have been much higher in the past; in 1990-91 subsidies were more than 20 percent of the catch value but were down to approximately two percent in 1996-99. Such zones are usually not reported to the government and, therefore, the complete picture of the MPAs in Japan has been largely unknown until now. Information on such local MPAs was collected through various sources, and a list of more than 1,000 MPAs was produced. Many of them take the style of self-imposed voluntary regulations. Nonetheless, it was suggested that free-riders of the conservation activities were uncommon. This is because agreements are usually made to maximize the benefit of the group of fishers and each member of the group monitors the compliance status of other members. The government has provided territorial use right for fishers, and this could have helped maintain such a selfgovernance framework. An export tax on fish and fish products, as an alternative to Pigouvian harvest or effort taxes, is introduced in a resource-trade model for a small open economy. It is analysed to what extent such a tax could mitigate biological and economic overuse of fish stocks and increase national welfare, which is affected both through the general government budget and through effects on consumer surpluses. We also discuss briefly implications for aquaculture environment, production and trade. It is demonstrated that a resource export tax may be beneficial for total national welfare compared to a laissez-faire policy. The theoretical analysis is illustrated by a stylized case study for a small open economy.
