  Citation × Citation Citation Abstract Copy Title: Transforming Regulatory Processes: Karuk Participation in the Klamath River Total Maximum Daily Load (TMDL) Process Author: Stoll, Shannan Year: 2016 This thesis examines the extent to which the Karuk Tribe has participated in natural resource management regulatory processes, using the Klamath River Total Maximum Daily Load (TMDL) process as a particular case study for evaluation. One of the most effective ways that the Tribe participates in the TMDL process is through the rigorous adoption of the technical tools of regulatory science. Collaboration with nontribal organizations is also used to build capacity for participation. The Tribe’s active participation in the TMDL process has in turn shaped the process, making it more inclusive of tribal values and traditional knowledge, improving overall scientific inquiry, and facilitating increased cooperation among tribal and non-tribal resource managers. At the same time, the Tribe’s participation in the process remains “uneven,” underscoring the ongoing challenge of making regulatory processes that recognize the legitimacy of tribal knowledge and values. This research study investigates how aesthetic and editorial practices and tools are used for different image forms and as part of the visual presentation. A research design that implements qualitative interviews, visual analysis, and focus groups was incorporated to examine visual effects and images at three specific sites. The pan-and-zoom effect and its variants as well as select titles from the filmography of Ken Burns were used as case studies for this dissertation. The findings from the analyses suggest that visual effects for still image forms and the repetition of these applications and strategies are significant to the content depicted in images, the scope of the visual presentation, and the capacity for audiences to connect to historical information in the film. I argue in each system there is a “confused notion” whose ambiguity underpins the available methods of rhetorical argument. For Perelman, the confused notion of the universal audience and its relationship to epideictic rhetoric determines the form of ethical persuasion that requires consensus in order to incite action for justice. For Gadamer, the confused notion of Vorurteil (prejudice, or fore- judgment) is used to critique tradition, Enlightenment reason, and historical hermeneutics. This mode of ethical argument suggests that open dialogue with an other is the best means for addressing prejudice in order to reach mutual understanding. I argue that by placing these two approaches to ethical argument into critical dialogue, their respective capacities, limitations, and distinctive rhetorical outcomes can be more clearly apprehended. The ephemeral nature of dance as discussed by Maxine Sheets-Johnston is compared to a method of engaging the world with acceptance of what is without expectation or judgment as described in writings on various Eastern concepts of non-attachment through mindful practice. Parallels are noted between the aforementioned writings and works on non-attachment by Sahdra, Shaver, and Brown as well as Patanjali's Yoga Sutras to demonstrate the capacity of improvisational dance as a mode of practicing non-attachment. The author's experience in exploration through her own improvisational practice is compared with other movement practices stemming from eastern traditions interested in non-attachment as a mind-balancing pursuit. Progress toward non-attachment as a result of this committed practice is quantitatively demonstrated through the use of a Likert-style scaled questionnaire.
